Traditional Owner Support Services for the Thayanaku and Orchid Creek Land Dealings

The Cape York Peninsula Tenure Resolution Program (the Program) within the Department of Environment and Science has the dual focus of returning ownership and management of land to Cape York Peninsula Aboriginal Traditional Owners, and protecting those areas of outstanding natural and cultural values through the dedication of national park (Cape York Peninsula Aboriginal land) and other mechanisms.

Land transferred to Aboriginal ownership is first subject to tenure negotiation with a Traditional Owner Negotiation Committee (TONC).   Traditional Owner support services are required for each land dealing, and a summary of services required are as follows:

  • correctly identify the Aboriginal people who hold or assert Native Title over that land, by:
    • consulting with Aboriginal people known to have connection to that land;
    • engaging anthropologists to review previous work and update information on apical ancestors and contemporary members of the Native Title parties;
  • support those Aboriginal people to participate in negotiations with the State, by
    • providing accurate information about the proposals in a culturally appropriate way;
    • working with the State to organise meeting venues, catering and Traditional Owner travel and accommodation;
  • assist Aboriginal people to identify economic, social, cultural and environmental goals and opportunities for the areas of land under negotiation, and the tenures and management structures that can help to meet those goals;
  • assist Aboriginal people to form landholding entities to own and manage land transferred to them through this Program;
  • provide Aboriginal people with independent legal advice in the negotiation of an Indigenous Land Use Agreement (ILUA), Indigenous Management Agreement (IMA) and other agreements with the State;
  • provide documentation to enable registration of the ILUA by the National Native Title Tribunal.
